China Cleaning Industry Association

　　China Cleaning Industry Association (CCIA) is the leading national trade association representing cleaning product industry in China.

　　Founded in 1983, the association is dedicated to fostering general information exchange among government, enterprises and consumers, safeguarding the legitimate rights and interests of members and consumers, and serving the development and growth of cleaning products industry in China.

　　Mission

　　To abide by the constitution, laws, regulations and governmental policies, observe public ethics and customs, be a good advisor and assistant to the government, reflect the wishes and requirements of its members, promote exchanges and communications among the government, industry, enterprises and public, focus on the service for its members, protect members’ and consumers’ legitimate rights and interests, and serve for social and industry progress.

　　Functions

　　Establish industrial regulations and rules, and promote their implementation;

　　Reflect to the government the wishes and requirements of members as well as relevant industrial issues, and bring about relevant recommendations in a bid to safeguard the legitimate rights and interests of its members;

　　Investigate and research issues appearing in the development of cleaning industry and associated line sectors and set forth suggestions associated with industry regulations and polices to the government;

　　Join in the formulation and revision of technical, economic and managing standards in cleaning industry and associated line sectors, and promote their implementation under the authorization of the government;

　　Carry out statistical work, information collection and release, market analysis and forecast to serve for the government and industry;

　　Conduct self-discipline supervision and evaluation over product quality and safety, release relevant information, and promote high quality products and new technology & products;

　　Organize international technology communication, exhibitions and trade fairs;

　　Organize related technical training, professional education and entrusted grade assessment;

　　Provide services such as the promotion, application and consultation of new technology, process and products at home and abroad;

　　Undertake the propaganda campaign for industry, enterprises as well as scientific knowledge;

　　Edit and publish magazines, journals, bulletins and industry report, etc., establish and employ official website and mobile internet to serve for the development of cleaning industry and associated line sectors.

　　Fulfill tasks assigned by governmental authorities or other organizations;

　　Participate in public welfare undertakings and other activities in favor of cleaning industry and associated line sectors.

　　The Constitution of China Cleaning Industry Association (CCIA)

　　Part I. Preamble

　　1. The name of our association is China Cleaning Industry Association (CCIA).

　　2. CCIA is a national NPO & NGO of enterprises, public services, research institutions, information centers and educational units for soap, detergent, surfactant and oleochemical industries as well as some relative realms.

　　3. The mission of CCIA is to abide by laws, regulations and governmental policies, observe public ethics and customs, be a good advisor to the government, reflect the wishes and requirements of its members, promote exchanges and communications among the government, industry, enterprises and public, focus on the service for its members, protect consumers’ rights, and serve for social and industry progress.

　　4. CCIA is approved and registered by China Ministry of Civil Affairs.

　　5. The location of CCIA is in Beijing.

　　Part II. Functions

　　6. The functions of CCIA are as follows.

　　6.1. To establish industrial regulations and promote their implementation;

　　6.2. To reflect to the government the wishes and requirements of members as well as relevant industrial issues, and bring about relevant recommendations in a bid to safeguard the legitimate rights and interests of its members;

　　6.3. To investigate and research issues appear in the development of the relevant line sectors, and set forth suggestions of policies and regulations to the government;

　　6.4. To be involved in the establishment and revision of technical, economic and managing standards in relevant line sectors, and promote their implementation under the authorization of the government;

　　6.5. To carry out statistical work, information collection and release, market analysis and forecast to serve for the government and industry;

　　6.6. To conduct autonomic supervision for product quality, release information of product quality;

　　6.7. To hold the domestic and foreign technological communication, exhibitions and trade fairs;

　　6.8. To organize the relevant technical training and professional education;

　　6.9. To provide the services such as the promotion, application and consultation of new technology, process and products at home and abroad;

　　6.10. To undertake the propaganda campaign for industry, enterprises as well as scientific knowledge;

　　6.11. To edit and publish journals of the Association, construct and develop industrial information website;

　　6.12. To fulfill the tasks assigned by governmental authorities or other organizations;

　　6.13. To be involved in public welfare undertaking and other activities in favor of the line sectors.

　　Part III. Membership

　　7. Membership is classified into corporate and individual members.

　　8. The following conditions must be satisfied to apply for the membership of CCIA.

　　8.1. To uphold the constitution of CCIA;

　　8.2. To have the willingness to join CCIA;

　　8.3. To have a certain influence and visibility in the business domain of CCIA;

　　8.4. The membership is open to enterprises, public services, research institutions, information centers and educational units which are legally registered and operating in China for soap, detergent, surfactant and oleochemical industries, raw materials, equipment & packaging as well as some relative realms.

　　8.5. The membership is open to the individuals who play an important role in production, R&D, education and consultation for soap, detergent, surfactant and oleochemical industries, raw materials, equipment & packaging as well as some relative realms.

　　9. The procedures of becoming a member are as follows.

　　9.1. Enterprises or individuals shall submit the application form;

　　9.2. The form shall be presented to the Council or the Standing Council for discussion and approval;

　　9.3. During the close of the Council or the Standing Council, the Secretariat shall be authorized to examine and approve the form, publicize it to all the members and notify the Council timely;

　　9.4 The membership certificate shall be issued by the Council or the authorized agency of the Council.

　　10. The membership rights

　　10.1. The rights of electing, being elected and voting;

　　10.2. The right of participating in the activities of CCIA;

　　10.3. The right to gain its service priority;

　　10.4. The rights of criticism, suggestion and supervision on CCIA’s work;

　　10.5. The rights of freewill becoming a member and withdrawal;

　　10.6. Other rights in accordance with the constitution.

　　11. The membership obligations

　　11.1. To abide by the constitution and implement the resolutions of CCIA;

　　11.2. To safeguard CCIA’s legitimate interests;

　　11.3. To complete all assigned work seriously;

　　11.4. To pay the membership fee by rule;

　　11.5. To reflect actual conditions and provide relevant information;

　　11.6. Other obligations in accordance with the constitution.

　　12. Members shall send the notification letter and return the Certificate if demanding withdrawal. If their obligations haven’t been fulfilled for 2 years, it shall be considered as an automatic withdrawal.

　　13. Serious violation of the Constitution must lead to removal from membership after being voted through the Council or Standing Council meeting first.

　　Part IV. Organization and Election & Removal of Directors

　　14. The General Assembly is the highest authority of CCIA, of which functions and powers are as follows.

　　14.1. To set up and amend the Constitution;

　　14.2. To elect and recall members of the Council;

　　14.3. To review the work report and financial report of the Council;

　　14.4. To decide the principles, tasks and major issues for CCIA’s work;

　　14.5. To set up and revise standards for membership fees;

　　14.6. To make decisions to continue or discontinue the work;

　　14.7. To determine other major issues.

　　15. The General Assembly shall be held with attendance of 2/3 of the members. The resolutions shall be adopted if voted for by more than half of members present at the meeting.

　　16. One Session of the General Assembly is for a term of 5 years. Due to special reasons, an early or delayed election must be adopted by the Council whilst approved by social organization management authority. But the longest deferrable time cannot surpass for one year.

　　17. The Council, as the executive institution, is responsible to the General Assembly and in charge of the daily affairs when the General Assembly is not in session.

　　18. Functions and powers of the Council

　　18.1. To implement the resolutions of the General Assembly;

　　18.2. To elect and recall the president, vice presidents, secretary general and standing council members;

　　18.3. To make preparation for hosting the General Assembly;

　　18.4. To present work report and financial report to the General Assembly;

　　18.5. To be responsible for recruitment and elimination of the membership

　　18.6. To decide the establishment, modification & cancellation of offices, branches, representatives and working groups

　　18.7. To decide the appointment of deputy general secretaries and directors of branches and offices;

　　18.8. To conduct the daily routines of branches and offices

　　18.9. To set up internal regulations and systems;

　　18.10. To decide other major issues.

　　19. The Council shall be held with attendance of 2/3 of its members. The resolutions shall be adopted if voted for by more than 2/3 of members present at the meeting.

　　20. The Council shall be convened at least once a year. Due to special reasons, it shall be hosted by using the communication media.

　　21. The Standing Council is elected by the Council, whose members shall be not more than 1/3 of the Council members. During the closing period of the Council, the Standing Council, responsible to the Council, shall exercise the functions and powers of 18.1, 18.3, 18.5, 18.6, 18.7, 18.8, 18.9.

　　22. The Standing Council shall be held with attendance of 2/3 of its members. The resolutions shall be adopted if voted for by more than 2/3 of members present at the meeting.

　　23. The Standing Council shall be convened at least once half a year. Due to special reasons, it shall be hosted by using the communication media.

　　24. The president, vice presidents and the general secretary shall meet the following requirements.

　　24.1. To play a very important role in the business domain of CCIA;

　　24.2. The maximum age for the president and vice presidents shall be 70 years old. The general secretary shall be not over 60 years old and full-time;

　　24.3. To keep healthy and work properly;

　　24.4. Never being subject to any criminal penalty of deprivation of political rights;

　　24.5. Having full capacity for civil conduct.

　　25. The president, vice presidents and general secretary shall leave office if they exceed the maximum age limit.

　　26. The president, vice presidents and general secretary are elected for a term of 5 years and shall serve no more than two consecutive terms.

　　27. The president shall be the legal representative of CCIA. Due to special reasons, the vice president or general secretary can be the legal representative with the approval of the president, the Council, and social organization management authority.

　　The legal representative shall sign the important documents on behalf of CCIA, who shall not serve as the legal representative of other associations simultaneously.

　　28. Functions and powers of the president

　　28.1. To convene and preside over the Council and the Standing Council;

　　28.2. To examine the implementation of the resolutions of the General Assembly, the Council and the Standing Council.

　　29. Functions and powers of the general secretary

　　29.1. To take charge of the daily routines, organize and implement the annual work plans;

　　29.2. To help coordinate efforts across the branches, representative offices and working groups;

　　29.3. To nominate the vice general secretaries and directors of the organization, to be determined by the Council or the Standing Council;

　　29.4. To decide the employment of the full-time staff of the branches, representative offices and working groups;

　　29.5. To deal with other daily routines.

　　Part V. Asset Management & Utilization 

　　30. Sources of funds

　　30.1. Membership fees;

　　30.2. Donation;

　　30.3. State funding;

　　30.4. Incomes from activities and services within the line of business;

　　30.5. Interest;

　　30.6. Other lawful incomes.

　　31. The membership fee shall be charged in accordance with the relevant state provisions.

　　32. The funds shall be used to promote the business development in accordance with the Constitution, not be distributed to the members.

　　33. Strict financial management system shall be established in order to guarantee the legality, truthfulness, accuracy and integrity of the fiscal materials.

　　34. The accounting personnel shall achieve the professional qualification in accounting, not hold the position of cashier concurrently. They shall carry on the accountant accounting and supervision. When being transferred to other work or leaving their posts, they must finalize the handing-over procedure with the persons who are taking over.

　　35. The asset management shall implement the financial management rules prescribed by the state and accept the supervision of the General Assembly and financial department. Asset coming from state funding or social donation shall accept the supervision of the auditing departments and publicize relevant information to the society properly.

　　36. The election and change of legal representative shall accept the financial auditing of the auditing body authorized by social organization management authority and business department in charge.

　　37. The assets shall not be illicitly distributed, seized or embezzled among any units or individuals.

　　38. The payrolls, welfare treatment and social security of the full-time staff shall be determined with reference to relevant Chinese regulations on institutions.

　　Part VI. Procedures for Amending the Constitution

　　39. The amendment to the Constitution shall be unanimously decided by the Council and submitted to the General Assembly for approval.

　　40. The amended Constitution shall come into force upon approval of the social organization management authority within 15 days after approval of the General Assembly.

　　Part VII. Termination Procedure & Disposition of Assets

　　41. The Council or the Standing Council shall propose the motion for termination when the association needs to be deregistered due to the completion of its missions, disbandment, split or merger.

　　42. The motion for termination shall be voted through at the General Assembly, then examined and approved by the social organization management authority.

　　43. Before dissolution or termination, a special liquidation committee shall be set up under the supervision of the business department in charge to deal with debts and credits and problems arising possibly. During the period of liquidation, no more other activities shall be carried out.

　　44. The termination of association shall be subject to the cancellation formalities by the social organization management authority.

　　45. According to relevant state regulations, surplus property after termination shall be used to focus on activities or undertakings that conform to CCIA’s aims under the supervision of social organization management authority.

　　Part VIII. Annex

　　46. This new Constitution is approved by the 1st Session of the 7th General Assembly on November 7th, 2013.

　　47. Its power of interpretation shall be vested in the Council of CCIA.

　　48. It shall take effect from the date of approval of the social organization management authority.
